A patent gives you the exclusive right to make, use, sell and import your invention in Pakistan for up to 20 years. It is the strongest protection a technical idea can get, but it is also the easiest to lose by acting in the wrong order. If you show your invention at a trade fair, publish it online or sell it before filing, you may destroy the novelty the patent depends on. This guide explains what can be patented in Pakistan, how the application works at the Intellectual Property Organization of Pakistan (IPO-Pakistan), and the mistakes that cost inventors their rights.
Quick answer: In Pakistan, patents are granted by IPO-Pakistan under the Patents Ordinance, 2000. You file an application with a description and claims (provisional or complete), the Patent Office examines it for novelty, inventive step and industrial application, accepted applications are advertised for opposition, and the patent is then granted. Protection lasts 20 years from the filing date, provided annual renewal fees are paid. Keep the invention confidential until you file.
What can be patented in Pakistan?
An invention qualifies for a patent if it meets three tests. It must be new (not disclosed anywhere in the world before the filing or priority date), it must involve an inventive step (not obvious to a skilled person in that field), and it must be capable of industrial application. An invention can be a product, such as a new machine part or formulation, or a process, such as a new method of treating water or manufacturing a material.
The Patents Ordinance also excludes certain subject matter. The main exclusions are:
- Discoveries, scientific theories and mathematical methods
- Aesthetic creations, which may instead be protected as industrial designs or copyright
- Schemes, rules or methods for doing business, playing a game or performing purely mental acts
- Computer programs as such, although a technical process that uses software may still be patentable
- Methods of treating humans or animals by surgery or therapy, and diagnostic methods
- Inventions whose commercial use would be contrary to public order or morality
If your idea falls outside patent protection, other routes may fit better. Brand names belong in trademark registration, and software code, manuals and artwork are covered by copyright registration.
Patent, design, trademark or copyright: which one protects your idea?
| Right | What it protects | Typical term in Pakistan |
|---|---|---|
| Patent | How a product or process works (technical function) | 20 years from filing, with annual fees |
| Industrial design | How a product looks (shape, pattern, ornamentation) | 10 years, renewable twice |
| Trademark | Brand names, logos and other signs | 10 years, renewable indefinitely |
| Copyright | Original literary, artistic and software works | Generally life of author plus 50 years |
Many products need more than one right. A new kitchen appliance could have a patented mechanism, a registered design for its shape and a registered trademark for its name. An intellectual property audit helps you see which assets you actually own.
How to file a patent application in Pakistan: step by step
- Run a prior-art search. Search patent databases and published literature to check whether the invention is genuinely new. This saves fees on an application that cannot succeed.
- Prepare the specification. Write a full description of the invention, drawings where needed, an abstract and the claims. The claims define the legal boundary of your protection, so they need careful drafting.
- Choose a provisional or complete filing. A provisional specification secures an early filing date while you finish development. The complete specification must follow within the period allowed by the rules, usually 12 months.
- File with IPO-Pakistan. Submit the prescribed forms, specification and fee at the Patent Office. Foreign applicants and many local applicants file through a registered patent agent.
- Request and respond to examination. The examiner checks formalities and substantive patentability and may issue objections. You respond with arguments or amendments within the time allowed.
- Acceptance and advertisement. An accepted application is advertised in the official journal so that third parties can oppose it within the statutory period.
- Grant and sealing. If there is no successful opposition, the patent is granted and the certificate issued. Renewal fees then become due each year to keep it in force.
How long does patent registration take in Pakistan?
Plan for a multi-year process rather than months. The timeline depends on the examination backlog, the complexity of the technology, how many objections are raised and whether anyone opposes. A clean application with well-drafted claims moves faster than one that needs repeated amendments. Your rights date back to the filing date, so the most important deadline is the one you control: filing before any public disclosure.
Claiming priority from a foreign application
Pakistan is a member of the Paris Convention. If you first filed in another member country, you can file in Pakistan within 12 months and claim that earlier priority date. Pakistan is not a member of the Patent Cooperation Treaty (PCT), so an international PCT application does not by itself extend to Pakistan. A separate national application is needed within the Paris Convention deadline.
Common patent mistakes Pakistani inventors make
- Disclosing before filing. Demonstrations, exhibitions, online videos and sales can all destroy novelty.
- Weak or narrow claims. A competitor can design around claims that describe only one exact version of the invention.
- Ignoring ownership. If an employee or contractor developed the invention, check employment contracts and assignments before filing in the company name.
- Missing renewal fees. A granted patent lapses if annual fees are not paid on time.
- Filing only in Pakistan. If you plan to export, consider protection in target markets within the 12-month priority window.
Do you need a patent agent?
The law allows individuals to file, but drafting claims and answering examination objections are technical legal tasks. A poorly drafted specification cannot simply be rewritten later to cover what you forgot. Foreign applicants generally must act through a local agent with an address for service in Pakistan.
Frequently asked questions
How long is a patent valid in Pakistan?
A Pakistani patent lasts up to 20 years from the filing date of the application, provided the annual renewal fees are paid on time.
Which office grants patents in Pakistan?
Patents are granted by the Patent Office of the Intellectual Property Organization of Pakistan (IPO-Pakistan) under the Patents Ordinance, 2000.
Can I patent software in Pakistan?
A computer program as such cannot be patented, but an invention that produces a technical effect and uses software as part of it may qualify. Software code itself is protected by copyright.
Is Pakistan part of the PCT system?
No. Pakistan is not a PCT member, so you need a national application. As a Paris Convention member, Pakistan lets you claim priority from a foreign filing made within the previous 12 months.
Can I sell my product before filing a patent?
You should not. Selling, publishing or exhibiting an invention before filing can destroy its novelty and make it unpatentable. File first, then disclose.
